Personal Data Protection Act 2010 Notice

Bhd.) and its related corporations, subsidiaries, and affiliates forming part of the Ascentium Group of companies (hereinafter collectively referred to as “Ascentium Group” or “we” or us” or “our”) is committed to safeguarding your privacy. We wish to assure you that your personal data under our care is safe and secured in line with the Personal Data Protection Act 2010 (the “Act”).

By providing your personal data to us and/or by continuing to access our website or use any of the services offered by us, you acknowledge that you have read and understood this Notice and consent to us processing your personal data as a data controller in accordance with the manner as set out herein. The terms “personal data”, “processing” and “data controller” used in this Notice shall have the meaning prescribed in the Act.

1. Consent

This Notice serves to inform you that your personal data is being processed by us or on our behalf and you hereby give your consent to the processing of your personal data in accordance with the manner as set out in this Notice.

2. Description of Personal Data

We may collect and process personal data relating to you and/or other individuals connected with you or the relevant entity (including directors, shareholders, beneficial owners, authorised representatives, employees or contact persons) for the purpose of providing our services and in the course of your dealings with us. Such personal data may include, but is not limited to, the following:

(‍a) General and Contact Information – Name, age, gender, date of birth, nationality, home addresses, e-mail addresses, telephone details, marital status, photos, sensitive information, employment related information such as former employers’ names, addresses and contact numbers, employment history, educational background, job title or position, employment location, skills, experience, employment references and/or all other personal data that you provide/declare to us and/or that are collected from you by us in the course of your dealings with us.

(b) Financial and Account Information- Credit or debit card details (for payment purposes), bank account information, transaction records, invoices, accounting records, remuneration details and/or any other relevant financial information relevant to the services provided.

(c) Identification Information – Malaysian Identification Card numbers, birth certificate number, passport number, employment pass or work permit number, Employees’ Provident Fund (EPF) account numbers, tax identification number, SOCSO account numbers, biometric data, signatures, driver’s or other licensed number.

(d) Taxation and Regulatory Information – Personal data contained in tax filings, statutory submissions, audit or investigation documentation, correspondence with regulatory or tax authorities, and information relating to tax compliance, advisory, audit, investigation or dispute resolution matters.

(e) Employment, Payroll and Statutory Information- Employment details, salary and remuneration information, payroll data, statutory contribution records, tax deduction information, benefit information, and related employment data.

(f) Corporate and Ownership Information– Directorship information, shareholding details, beneficial ownership information, authorised signatory details, and other corporate governance or compliance-related personal data where applicable.

(g) Communication – Communication in any form, including via e-mails, short message service (SMS), WhatsApp, and/or any other mode of communication between our representatives and you.

3. Purposes of Processing of Personal Data

We may collect and process your personal data for the following purposes (the “Purposes”):

(a)  to provide corporate secretarial, accounting, bookkeeping, payroll, taxation, ESG advisory, assurance, expatriate immigration services, Labuan and other offshore services, and related professional services to you and/or the relevant entity;

(b) to communicate with you in connection with the provision of such services;

(c) to perform our obligations and business functions pursuant to any contract or agreement;

(d) to comply with all applicable laws, rules, regulations, guidelines and/or other legal or regulatory requirements, as well as requirements of the government, law enforcement agencies, and any other authorities to whom we are subject to, or any orders of the Court;

(e) to prepare and submit statutory or regulatory filings and to liaise with relevant government agencies, regulatory authorities, financial institutions and other relevant bodies;

(f) to conduct due diligence, compliance, screening and verification processes, including background checks;

(g) for internal administrative, operational, governance, audit, quality assurance and record-keeping purposes;

(h) for the purpose of establishing, exercising or defending legal rights, or responding to actual or potential legal proceedings or regulatory and non-regulatory bodies investigations or queries;

(i) for human resource administration, management and training purposes;

(j) for publication in any printed materials, website, electronic media and/or social media platforms arising from your participation in any of our and/or Ascentium Group’s related events, meetings or activities; and

(k) for any other purposes which are directly related to the above.

4. Sources of Personal Data

We may collect your personal data directly from you or from a variety of sources, including but not limited to the following:

(a) through your communications and interactions with us including when you submit request forms, make enquiries about our services via email, telephone, our websites or social media platforms, or otherwise engage with us;

(b) from Ascentium Group companies where they are providing services to you or are otherwise engaged in connection with our services;

(c) through cookies, IP addresses, location services and other tracking technologies when you visit our websites or when you fill in contact us forms within our website;

(d) from your verbal and written communications with us and/or our authorised personnel via SMS, phone or mobile device, email, fax, mail, websites, social media and/or any other appropriate communication channels;

(e) from recordings of Closed-Circuit Television (CCTV) installed at our premises;

(f) from compliance and screening databases, sanctions list, and other publicly available or commercially available sources for anti-money laundering, counter-terrorism financing and other regulatory compliance purposes;

(g) from such other sources in respect of which you have given your consent to them disclosing information relating to you and/or where they are not otherwise restricted.

5. Disclosure of Personal Data

We may disclose your personal data for the abovementioned Purposes to the following parties (including those within and outside Malaysia) to the extent necessary to fulfil the Purposes or a directly related purpose:-

(a) Any member of the Ascentium Group, including its subsidiaries and affiliates;

(b) Any intermediaries, agents, contractors, sub-contractors or third-party service providers who provide services to the companies within the Ascentium Group or are engaged to support delivery of services to you;

(c) Any government agencies, statutory bodies, and other regulatory authorities;

(d) Any person who is under a duty of confidentiality and/or who has undertaken the responsibilities to keep such personal data confidential;

(e) Our assignees or potential assignees, acquirers or potential acquirers and successors-in-title of the business or share (wholly or in part) of the Ascentium Group (including their advisers and representatives) as a result of a potential, proposed or actual sale of business, disposal, acquisition, merger or re-organisation;

(f) Any such third party requested or authorised by you for any of the above Purposes, in respect of whom you have consented to the disclosure of your personal data.

6. Transfer of Personal Data to a Place Outside Malaysia

Your personal data may be transferred to a place outside Malaysia, for the Purposes set out in this Notice, including for administrative, operational, or business purposes or reasons, where such transfer is permitted or required under applicable law.

By providing your personal data to us, you consent to such cross-border transfers. Where such transfers occur, we will take reasonable steps to ensure that they are carried out in accordance with applicable data protection laws and that appropriate safeguards are implemented to protect your personal data.

7. Retention of Personal Data

We may retain your personal data for as long as necessary for the purpose of fulfilling the Purposes or as required and/or if such retention is necessary for our operational, legal, audit, regulatory, tax, or accounting requirements, to the full extent permitted by the law.

8. Other Individuals’ Personal Data

When providing other individual’s personal data to us, you undertake:

(a) to notify the individual of this Notice; and

(b) to acquire any legal consent for the collection, use, disclosure, and transfer (including international transfer) of personal data relating to the individual pursuant to this Notice.

9. Right to Request Access to, Correction of, and Limiting the Processing of Personal Data

You have the right to request access to and to request correction of your personal data and to contact us with any inquiries or complaints in respect of your personal data (including the possible choices and means for limiting the processing of your personal data or to cease or not begin processing your personal data for purposes of direct marketing) from:

10. Withdrawal of Consent

You have the right to withdraw your consent previously given to us (in full or in part) subject to any applicable legal restrictions, contractual conditions and a reasonable duration of time for the withdrawal of consent to be effected by providing us with a notice in writing. If you withdraw your consent to any or all use of your personal data, we may not be in a position to continue to administer any contractual relationship in place, which in turn may result in the termination of any contracts or agreements with us. In such circumstances, we will not be liable for any losses, damages or consequences arising from such withdrawal of consent resulting in the termination of contracts or agreements.

11. Accuracy of Personal Data

You are responsible for ensuring that the information that you provide to us is accurate, complete, not misleading and kept up to date.

12. Amendments to this Notice

We reserve the right to update or amend this Notice from time to time to reflect changes in our business operations, legal or regulatory requirements. Any such updates or amendments will be made available on this website and shall take effect upon publication. You are advised to review this Notice periodically to stay informed of any such updates or amendments. The updated or amended Notice shall apply to you from the effective date of publication, and your continued engagement with us and/or access to our websites after such publication will be taken as an indication that you have read and understood the updated or amended Notice.

13. Conflict

In the event of any inconsistency between the English version and the Bahasa Malaysia version of this Notice, the English version shall prevail over the Bahasa Malaysia version.
